Minister of Justice Has Drafted Law to Extend Deadline to Reclaim Luxembourg Citizenship
[New York, May 14th] LuxCitizenship is able to confirm publicly today that the Honorable Sam Tanson, Minister of Justice of Luxembourg, has drafted a bill to change the December 31st, 2020 deadline to sign a declaration reclaiming Luxembourg nationality. The proposed bill is being drafted because of the exceptional global situation under the Covid19 Coronavirus. The proposed bill would extend the deadline to sign the declaration by one year. This would make the new deadline December 31st, 2021 to sign a declaration of nationality before a Civil Registrar in Luxembourg.
The bill or “project of law” concerns amending the deadline in Article 89 Subsection 2 of the Luxembourg Nationality Law of March 8, 2017. Therefore, the deadline extension will only apply to individuals who requested a Luxembourg Ancestor Certificate before December 31st, 2018. The bill will not allow new applicants to apply for a Luxembourg Ancestor Certificate under Article 89.
The Luxembourg Ministry of Justice does not publicly publish bills under its normal operating procedures. Any bill will be announced and published in and by the Luxembourg Chamber of Deputies (Chambre des Députés). The Luxembourg Ministry of Justice also does not make press announcements about any proposed legislation.
As with any proposed legislation in Luxembourg, the bill will first be submitted to the Government for review. If approved, the bill will undergo the normal legislative process in the Luxembourg Chamber of Deputies. Therefore, the eventual legislation will depend on the eventual approval by a majority vote in the Chamber of Deputies. Considering this, the legislation could also be amended by the Deputies in any way before potentially becoming law. Until an eventual law would pass, the December 31, 2020 deadline remains the law.
LuxCitizenship also announced today that it will be organizing two new webinar sessions in the coming weeks. The first session “Covid19 in Luxembourg” will be a panel discussion with individuals living in Luxembourg under Covid19. The second session will be “Schoolhouse Rock Luxembourg” with a panel of experts explaining the legislative process in Luxembourg.
